OF SERVICE


By commissioning me for custom artwork, apparel & other merchandise, you are willingly and officially agreeing to the following Terms of Service. If these terms are broken, you may be refused future commissions or services.

All terms are equal in weight and importance.

IMPORTANT UPDATE (7/22/2026):

As of July 15th, 2026, ELLY MOO is officially registered as a business in New Jersey. Because of this, I am legally required to collect sales tax on all New Jersey transactions. If you are ordering within NJ, you will pay sales tax on all orders! If you are out of NJ, this does not apply. Thank you~!

Payment (via Stripe Invoice, OR Payment Link)

Standard Commissions

  • Full payment must be sent within 48 hours of receiving the invoice.

  • If payment is not made within this timeframe, your commission slot may be canceled and reopened to other clients.

  • Once payment is finalized, if you choose to cancel, you will only receive a partial refund! (50%) This is to ensure that everyone receives a fair estimated time of completion.

Rush or High-Demand Slots

  • Payment must be completed within 24 hours of receiving the invoice.

Chargebacks

  • Any chargeback filed without contacting me first will result in:

    • Immediate cancellation of the commission.

    • A ban from future services.

    • Reversal of rights to the artwork (you may not use or repost any completed or in-progress work, doing so may result in legal action).

Payment Plans

Payment plans may be offered for commissions over $300 USD.
Requirements:

  • 25% non-refundable deposit upfront.

  • Weekly or monthly plans available depending on project scope.

  • No yearly plans unless the project exceeds $10,000 USD.

(For deposit estimate: multiply the commission price by 0.25.)

Usage Rights

Personal Use

You may:

  • Use the commissioned artwork for personal purposes (icons, banners, wallpapers, private prints, etc.).

  • Post or share the artwork online with proper credit to Elyssa Caravaca (Elly Moo)

Edits & Modifications

You may not:

  • Make major edits to the artwork (e.g., recoloring, removing watermarks, altering anatomy).

  • Use AI to modify, trace, or recreate the artwork.

You may:

  • Make minor non-destructive edits such as cropping, resizing, or adding borders.

Copyright & Commercial Rights

  • I, the artist, retain full copyright to the artwork unless explicitly transferred.

  • You may not claim the artwork or its creation process as your own.

  • You may not produce merchandise or commercial products using the artwork unless you purchase commercial rights*.

*Commercial Rights Add-On

  • Commercial usage rights can be purchased for an additional flat fee: $250 USD.

  • With commercial rights, you may produce products (prints, charms, apparel, etc.) using the commissioned artwork. 

  • YOU MAY NOT USE THE ARTWORK FOR GENERATIVE IMAGES/MACHINE LEARNING. (Legal action will be taken if done so.)

  • You will receive a written certificate confirming the transfer of commercial rights.

  • This does not apply to the resale of merchandise produced through ELLY MOO’s manufacturers. You do not need a copyright license to resell merchandise.

  • You WILL need a license if you were to produce merchandise with your own manufacturer.

Unauthorized commercial use is a violation of copyright law (see DMCA documentation) and may result in legal action.

NSFW Content

I do accept NSFW commissions as long as the content is legal and follows the following guidelines. Below is a clear outline of what I will not draw.

I WILL NOT Draw:

  • Animal genital anatomy (Even on anthros, excluding dragon + fantastical creatures.)

    • I will only draw humanistic genitalia. 

  • Fat fetishization/Feederism

  • Feral NSFW

  • Extreme hyper/female objectification

  • ABDL/DDLG

  • Coprophilia/Eproctophilia

Important:

  • All characters must be 18 years or older with verifiable adult designs.

  • I reserve the right to decline any NSFW request at my discretion for any reason (comfort, safety, legality, etc.).

  • NSFW commissions may incur additional fees based on complexity.

  • By commissioning NSFW work, you confirm that you are 18+. (I will require a photo ID. This is kept confidential.)

If you are found to be falsifying your identity you will be banned from future commissions.

Revisions & Artistic Limitations

  • I will provide WIP (work-in-progress) updates during the commission process.

  • Minor revisions are allowed during the sketch and early rendering stages.

  • Major changes requested after a stage has been approved may incur additional fees.

  • I may decline requests based on complexity, subject matter, or personal comfort.

Refund Policy

  • Refunds are only available before significant work has begun.

  • The 25% deposit (if applicable) is non-refundable.

  • Once the artwork is more than 50% complete, refunds will not be issued.

  • If I must cancel the commission for personal reasons, you will receive a full refund.

Client Agreement

By commissioning me, you acknowledge that:

  • You have read and agree to all terms listed above.

  • Violating these terms may result in cancellation of the commission and/or refusal of future service.

PHYSICAL SIGNATURE, MAKING A PAYMENT VIA INVOICE/PAYMENT LINK/online store purchase, OR CLICKING “I AGREE” IN a COMMISSION FORM BINDS YOU TO THIS CONTRACT/TOS.
